2023 Alive At Five Terms and Conditions (as of May 5, 2023)
TERMS AND CONDITIONS OF PURCHASE The following are the terms and conditions of admission to Alive At Five in Stamford Downtown. In consideration for the opportunity to attend an event, and by entering the venue, each attendee agrees to such terms and conditions, which apply regardless of the form of any ticket or other invitation to an event, or where or by whom such ticket or invitation is held, stored, or displayed.
Alive At Five is 21+ only. No exceptions (including infants & strollers) Please do not purchase a ticket for anyone under 21, they will not be admitted and tickets are non-refundable.
Photo ID is required for entry (valid and current motor vehicle operator’s license, identity card issued by the State Department of Transportation or a valid and current Passport or Global ID along with another form of photo ID) Digital IDs not accepted.
No Re-Entry. Once an attendee leaves the music venue, they may not re-enter on same ticket. Police reserve the right to limit entry due to crowd control, regardless of whether or not an attendee has a ticket (in which case a refund will be given).
WEATHER: This is an all-weather event. Please come prepared. However, storms may cause the venue to be unsafe for performers, staff, volunteers and attendees may be prohibited from entering or remaining in the venue in such an instance. If an event is cancelled before the doors open, refunds will be issued. If an event must be cancelled for safety reasons after the doors open, refunds will not be given. If an event is canceled due to artist cancellation, no action is required to obtain a refund; ticket holders will receive a refund to the original method of payment used at time of purchase. RULES, INSTRUCTIONS, DIRECTIONS: The attendee must follow all rules of Alive At Five, and all posted and/or verbal directions and instructions of Alive At Five staff and volunteers, while present on Alive At Five venue. Failure to abide by such rules, instructions and/or directions may result in expulsion from the venue.
PROHIBITED ITEMS: Attendee and their belongings may be searched upon entry to the venue. Attendee consents to such searches and waives any related claims that may arise. If attendee elects not to consent to such searches, attendee may be denied entry to the event without refund or other compensation. Security professionals at all entry portals will ensure that all attendees adhere to the following limitations on entry:
• No outside alcoholic beverages
• Factory sealed non-alcoholic beverages in plastic bottles are permitted. No personal containers.
• No illegal substances of any kind
• No coolers
• No bicycles, skateboards, rollerblades, hover boards or sporting equipment of any kind
• No weapons or firearms
• No pets (Service dogs are permitted with valid license)
• No camera with detachable lenses or video cameras, no audio recording equipment
• No drones • No tents
• Chairs and/or blankets are permitted in designated areas of General Admission Area only (No chairs/blankets in VIP)
• Mill River Park is a Non-Smoking Venue
FOOD AND DRINK will be available for purchase at the venue.
PHOTO RELEASE: Attendee understands that at this event or related activities, they may be photographed. Attendee agrees to allow their photo, video, or film likeness to be used for any legitimate purpose by the event holders, producers, sponsors, organizers, and assigns.
WAIVER AND RELEASE OF LIABILITY; INDEMNIFICATION: In exchange for admission to Alive At Five venue, attendee hereby releases, discharges, and agrees to hold harmless Stamford Downtown Special Services District, Mill River Park Collaborative, the City of Stamford, and their respective affiliates, and their respective directors, officers, volunteers, employees, agents, contractors and representatives; other concert attendees; event performers/performer; sponsors, advertisers and vendors; and the successor and assigns of each of them (each considered one of the “Releasees” herein), to the fullest extent permitted by law, from any and all liability, claims, demands, losses, and damages, which Attendee has or may have for any claims or causes of action arising out of or relating in any manner to attendance at the venue; attendance at, observation of and/or participation in any event at the venue; or any related activities. In further exchange for admission to the venue, Attendee agrees to indemnify, defend and hold harmless any and all Releasees from and against any and all demands, suits, claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees and expenses), including but not limited to, any claims by or on behalf of Attendee, arising out of or relating in any manner to (i) Attendee’s attendance at the venue; attendance at, observation of, and/or participation in any event at the venue; or any related activities, or (ii) Attendee’s acts or omissions. In exchange for admission to Alive At Five venue, Attendee covenants not to sue (or assist any person in suing) any Releasee for any matter related to the above assumptions, releases, indemnifications, or agreements. COVID-19: In accordance with local guidelines at this time, there will be no vaccination, testing or masking requirements at this event. However, the event shall be presented in accordance with applicable public health conditions as of the date of the event. If any attendee does not comply with any laws, mandates, health orders or directives, conditions or rules, in place at the time of the event, then the event operator may refuse admission to the event or require the attendee to leave the venue and such attendee will not be entitled to a refund. Attendee acknowledges that an inherent risk of exposure to COVID-19 exists in any public place where people are present. Attendee voluntarily assumes all risks to themselves and their close contacts related to exposure to COVID-19 and other bacteria, virus, or pathogen capable of causing a communicable disease or illness. Attendee waives any and all claims and potential claims against Stamford Downtown, the City of Stamford, Mill River Park Collaborative, Artists, Vendors and Sponsors relating to such risks, hazards, and dangers.
Attendee agrees to comply with all Alive At Five applicable rules, policies, terms, and conditions. Alive At Five reserves the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct is deemed disorderly by event management, or who fails to comply with Alive At Five rules. Breach of terms or rules will terminate attendee’s license to attend the event without refund. A ticket is not redeemable for cash. No Refunds.
